SALES TERMS & CONDITIONS

This document sets forth the Sales Terms and Conditions governing all quotations, sales, deliveries, and services provided by A1A CONSTRUDECOR LLC.

1. Estimates

Estimates are valid for 5 calendar days unless otherwise stated. Prices, freight, and availability are subject to change without notice after expiration.

2. Orders

Orders become binding only after written acceptance by A1A CONSTRUDECOR LLC and receipt of the required deposit or full payment.

3. Pricing

Pricing errors may be corrected prior to order acceptance. Taxes, delivery charges, and installation are excluded unless specifically listed.

4. Special & Custom Orders

Special Orders and custom cabinets, quartz countertops, closets, blinds, doors, and other made-to-order products are non-cancelable, non-refundable, and non-returnable once production or procurement begins.

5. Payment Terms

Accepted payment methods include cash, major credit cards (a 3.98% processing fee applies to all debit and credit card transactions), ACH, wire transfer, Zelle, and approved financing. Outstanding balances must be paid before release of materials.

6. Customer Pickup

Customers are responsible for inspecting and verifying all materials before leaving the warehouse. Once the materials have been inspected, accepted, and picked up, the customer assumes full responsibility for confirming that the products received match the order.

7. Vehicle Requirements

Customers must provide a suitable vehicle for pickup. We reserve the right to refuse to load any unsafe or overloaded vehicle. Any loading performed in the customer’s direction is done entirely at the customer’s sole risk and responsibility.

8. Delivery

Delivery dates are estimates only. A1A CONSTRUDECOR LLC is not liable for delays caused by suppliers, manufacturers, weather, freight carriers, customs, labor shortages, or events beyond its control.

9. Installation

Do not install any product until the color, shade, caliber, finish, dimensions, and quantity have been verified. Installation constitutes full acceptance of the product. A1A CONSTRUDECOR LLC will not accept responsibility for any product that has been installed if the defect was visible prior to installation

10. Product Variations

Natural variations in color, veining, texture, shade, dye lot, and size are inherent characteristics of tile (The product may have a slight variation of tone or shade between the sample and actual stock), natural stone, SPC flooring, quartz, wood, and similar products and are not manufacturing defects. Polished porcelain may exhibit natural variations in color, sheen, and surface smoothness due to lighting conditions. These variations are affected by light and brightness. No claims will be accepted due to these changes in surface appearance.

11. Vinyl Flooring

Vinyl flooring is sold without warranty. If not installed with the required underlayment and moisture barrier, the subfloor must be properly leveled, and the product must be acclimated prior to installation.

12. Returns

Stock items may be returned within 15 days if unused, uninstalled, in original packaging, and accompanied by the original invoice. Approved returns are subject to a 35% restocking fee.

13. Non-Returnable Items

Special orders, custom products, fabricated countertops, cabinets, closets, blinds, opened setting materials, adhesives, grouts, sealers, clearance items, installed products and discontinued products are not eligible for return.

14. Refund Method

Refunds will be issued only to the original method of payment (credit card, Zelle, or check). A 5% administrative fee will apply to all refunds processed for purchases made using a debit or credit card.

15. Warranties

Manufacturer warranties apply where available. A1A CONSTRUDECOR LLC does not warrant labor, installation, misuse, abuse, improper maintenance, or third-party workmanship. If an inspection is requested and no product defect is found, the cost of the inspection will be charged to the customer.

16. Limitation of Liability

Liability is limited to the purchase price of the affected materials. Under no circumstances shall A1A CONSTRUDECOR LLC be responsible for labor costs, project delays, lost profits, temporary housing, storage, reinstallation, or consequential damages.

17. Governing Law

These Terms are governed by the laws of the State of Florida. Venue for any dispute shall be Miami-Dade County, Florida.

 

Customer Acceptance

The customer further acknowledges that these Terms and Conditions form an integral part of every quotation, sales order, invoice, and purchase transaction with A1A CONSTRUDECOR LLC.
